1. Using this website
By using the website or submitting an order, account, enquiry or quotation request, you agree to these Terms to the extent they apply to that activity. If you do not agree, do not submit a transaction through the site.
Specific written terms on an accepted quotation, invoice, purchase order acknowledgement or special-order confirmation form part of that transaction and take priority where they directly conflict with a general website term.
2. Product descriptions, images and dimensions
We aim to provide useful product information, but photography, screens, natural materials, manufacturing batches and supplier changes can create reasonable visual differences. Images are illustrative unless an exact characteristic is expressly confirmed.
If size, colour, finish, load, configuration or compatibility is critical, confirm it before ordering.
3. Prices, promotions and availability
Prices are in Kenyan shillings unless stated otherwise and may change before an order is accepted. A product remaining visible online does not guarantee that the exact item, colour or quantity is available.
We may correct an obvious pricing, description or stock error before fulfilment and will contact you where the correction affects the order.
4. Orders and acceptance
Submitting checkout or an enquiry is an offer/request to transact, not an unconditional guarantee of fulfilment. We may need to confirm stock, product options, payment, destination or other details before acceptance.
We may decline or cancel an unfulfilled order where stock is unavailable, payment cannot be verified, information is materially incorrect, delivery cannot reasonably be arranged, or fraud/security concerns arise.
5. Payment
The Payment & Order Policy forms part of these Terms. Use only payment details shown or formally confirmed by Livespace Furniture. Orders subject to payment verification may remain pending until verification is complete.
6. Delivery and fulfilment
The Delivery Policy and Shipping & Fulfilment Policy form part of these Terms. Customers must provide accurate delivery and access information. Delivery timing is estimated unless a specific appointment is confirmed.
7. Returns, defects and refunds
The Returns & Refunds Policy applies to return requests. No fixed change-of-mind return period was supplied in the client’s public business details, so customers should contact us promptly after delivery. Faulty, wrong or damaged goods are assessed according to the circumstances and applicable rights.
8. Specially sourced, customised and made-to-order products
The customer is responsible for checking specifications before a special order is committed. Custom orders may create supplier, production or material commitments and can carry specific deposit, cancellation and return terms stated on the quotation or invoice.
9. Quotations, tenders and purchase orders
Quotations may have validity periods, stock conditions, substitutions, lead times, payment terms and delivery conditions. Unless the quotation says otherwise, it does not reserve stock indefinitely.
A customer purchase order should match the accepted quotation. Any change to quantities, specification, delivery or commercial terms should be agreed in writing.
10. Promotions and discount codes
Promotions may have specific dates, eligible products, minimum quantities or other conditions. Unless stated otherwise, promotions cannot necessarily be combined and do not apply retrospectively to completed orders.
11. Files, images and RFQ documents
By uploading a file, you confirm that you are authorised to provide it and that it does not contain unlawful content, malware or information you are not entitled to share. Upload only information relevant to the furniture requirement.
12. Customer accounts
You are responsible for keeping account credentials confidential and for notifying us if you reasonably suspect unauthorised access. We may suspend access where necessary to protect the website, customer information or transactions.
13. Acceptable use
Do not misuse the website, attempt unauthorised access, interfere with security, submit malicious code, scrape protected systems at unreasonable scale, impersonate another person or use the service for unlawful activity.
14. Intellectual property
Livespace Furniture branding, original website text, graphics, layout and code are protected by applicable intellectual-property rights. Third-party manufacturer names, images and trademarks remain the property of their respective owners.
15. Third-party services
The site may use or link to services such as WhatsApp, maps, analytics, payment providers, hosting or couriers. Their independent services are subject to their own availability, terms and privacy practices.
16. Liability
Nothing in these Terms excludes liability or customer rights that cannot legally be excluded. To the extent permitted by law, we are not responsible for indirect or consequential loss caused by matters outside the scope of the agreed transaction or by customer misuse, inaccurate site information supplied by the customer, or unauthorised modification of products.
17. Events outside reasonable control
We are not responsible for delay or failure caused by events reasonably outside our control, including severe transport disruption, public restrictions, supplier interruption, extreme weather, fire, security incidents or infrastructure failure. We will make reasonable efforts to communicate and manage affected orders.
18. Governing law, disputes and severability
These Terms are governed by the laws of Kenya. Customers should first contact Livespace Furniture so a complaint or dispute can be reviewed directly. Where a dispute cannot be resolved, the parties may use any dispute-resolution or court process available under applicable Kenyan law.
If one provision is found unenforceable, the remaining provisions continue to apply to the extent legally possible. We may update these Terms, with the effective date showing the current published version.
